Dreptul la imagine?

Scandalurile mondene, precum cel recent care a implicat-o pe Mihaela Rădulescu, sunt adesea prilej de invocare a “dreptului la imagine”. Încolţite de paparazzi, vedetele rezistă cât rezistă oferind replica mincinoasă şi stereotipă – “Nu-mi pasă ce scriu tabloidele despre mine, pot scrie orice pntru că îmi fac reclamă” – pînă cînd moralul lor cedează şi ajung să comită gesturi violente împotriva acestora sau să-i acţioneze în instanţă sub pretextul că le-a fost afectat “dreptul la imagine”.
Nu doar vedetele de film sau de televiziune întâmpină sistematic probleme cu dreptul la imagine. Politicienii, de exemplu, ripostează şi ei la bârfele oferite de jurnalişti în paginile publicaţiilor de scandal sau pe platourile de televiziune, acuzându-şi defăimătorii că îi calomniază şi le distrug reputaţia.
Dar ce este acest “drept la imagine”, la “propria reputaţie”, la “apărarea demnităţii”? Nimic altceva decât un construct retorico-juridic lipsit de substanţă, precum multe alte “drepturi” inventate de dragul garantării unui privilegiu. Spre deosebire de dreptul de proprietate asupra propriei persoane şi rezultatelor muncii noastre – şi de cel conex, dreptul la autoapărare – drepturile invocate de politicieni şi entertaineri sunt o simplă invenţie. Imaginea unei persoane nu poate face obiectul proprietăţii acesteia, după cum bine ne învaţă Walter Block, în “Pledoarii imposibile”. Nimeni nu are dreptul la propria “imagine” sau “reputaţie”, pentru simplul motiv că acestea nu sunt creaţia sa, ci rezultatul impresiilor pe care restul indivizilor le deţin cu privire la persoana sa.
Să subliniem că, spre deosebire de “propria” imagine, impresia pe care o am faţă de anumită persoană sau obiect este într-adevăr a mea. Gândurile şi impresiile pe care le am, sunt ale mele. Nimeni nu mi le poate interzice în mod justificat. Nimeni nu mă poate obliga să îmi schimb părerea cu privire la un anumit lucru. Aceasta este esenţa dreptului la liberă exprimare – un alt drept conex dreptului de proprietate.
Imediat ce observăm că nu putem apăra simultan dreptul la imagine şi dreptul la liberă exprimare (nu pot avea simultan dreptul de a spune orice gândesc şi obligaţia de a nu spune anumite lucruri), devine clar că argumentul pentru apărarea imaginii şifonate de critici (sau paparazzi) nu este altceva decât o tânguială jalnică sau o pledoarie comică, precum cea a “reclamantului” din reclama la sport.ro, care spune – “Am şi eu o reputaţie, … am şi eu o aroganţă!”. Adevărul este că nu ne construim “imaginea” aşa cum ne construim casa. “Imaginea” este impresia pe care o are cineva despre noi, după ce ne-a cunoscut sau ne-a văzut sau i s-a vorbit despre noi. Dacă nu ne convine, putem influenţa părerile celor din jur, chiar decisiv, convingându-i de falsitatea lor. Însă sub nicio formă nu-i putem obliga să creadă contrariul. Faptul că imaginea pe care o are restul lumii despre noi nu corespunde cu imaginea pe care o avem noi înşine despre propria persoană nu ne îndreptăţeşte să ne simţim lezaţi. Putem fi nemulţumiţi, furioşi, amărâţi, scârbiţi sau amuzaţi, dar nu suntem prejudiciaţi.
Paparazii nu fură nimic, tot aşa cum criticii literari sau analiştii politici nu distrug nimic. Tot ce fac este să livreze informaţii, păreri. Iar vedetele tv sau politicienii care nu suportă ce spun alţii despre ei ar trebui să fie mai convingători atunci când ies din rând şi ne prezintă caracterul lor sau faptele nobile ce le aparţin.
